Terms and Conditions
These terms govern use of the San Roku Ku website and the services, digital products, creative deliverables, and content we provide to clients internationally. Local mandatory laws may also apply depending on the customer, service, and place of supply.

1. General
- Our site and materials are provided for professional, informational, and commercial use.
- We may update these terms from time to time. The version published at the time of purchase applies to that order, unless a change is required by law.
- All services are subject to availability, payment, and acceptance of your order.
- Nothing in these terms excludes or limits a mandatory right or remedy that applies under the law of the customer's country or region and cannot legally be excluded by contract.
2. Services Covered
These terms apply to all San Roku Ku services and online purchases, including poster design, Filmhub artwork creation and correction, subtitle and SRT creation, subtitle translation, trailer creation, trailer revision rounds, rush delivery, source files, motion posters, social media artwork adaptations, social cuts, teaser cuts, and any related add-ons or digital deliverables.
Service descriptions, prices, package inclusions, turnaround estimates, revision limits, and add-ons are defined on the relevant service page and checkout flow at the time of purchase.
3. Intellectual Property
All films, images, text, designs, branding, code, website content, templates, workflows, and internal production materials created or owned by San Roku Ku remain the property of San Roku Ku or are used with permission. You may not copy, distribute, reproduce, modify, or publicly display any material without prior written consent.
For custom creative services, final approved deliverables are licensed to the client for the agreed project after full payment has been received. Editable source files, project files, working files, drafts, methods, presets, templates, and unused concepts are not included unless expressly stated in the package or purchased as an add-on.
San Roku Ku may display completed work in portfolios, case studies, promotional materials, social media, and on our website unless otherwise agreed in writing.
4. Client Materials and Permissions
Clients are responsible for ensuring they have all rights, licences, releases, consents, and permissions required for materials supplied to San Roku Ku, including film footage, stills, scripts, subtitles, music, fonts, logos, trademarks, names, likenesses, performances, artwork, references, and third-party materials.
You must not submit unlawful, infringing, confidential, defamatory, harmful, or unauthorised material. Business customers agree, to the extent fair and permitted by applicable law, to indemnify San Roku Ku against third-party claims, losses, and reasonable costs arising directly from materials or instructions they were not authorised to provide. This indemnity does not apply to consumers where it would be unlawful or unfair.
We may refuse, suspend, or cancel work if supplied materials appear unlawful, unsafe, rights-infringing, misleading, or unsuitable for the requested service.
5. Orders, Payment, and Taxes
Full payment is required before work begins unless otherwise agreed in writing. Payment secures a place in our production schedule but does not guarantee a specific outcome beyond the purchased service scope.
All payments are processed securely through third-party payment providers such as Stripe Checkout. San Roku Ku does not store, collect, or have access to your full card details.
Prices are displayed at checkout. You are responsible for any taxes, bank fees, currency conversion fees, platform fees, or charges imposed by third parties unless checkout states otherwise.
Failure to complete payment, provide required materials, or respond to essential project requests may result in suspension or cancellation of services.
6. Delivery Terms
Delivery timeframes are estimates unless expressly guaranteed in writing. Delivery depends on timely receipt of complete materials, client feedback, access credentials, passwords, approvals, and any required third-party information.
Delivery is considered completed once files, download links, transfer links, preview links, subtitle files, artwork files, trailer exports, source files purchased as add-ons, or access credentials have been sent to the contact information provided by the client.
We may use third-party hosting, file transfer, email, form, payment, and project management services to process orders and deliver work.
7. Revisions, Approvals, and Inactivity
Revision rounds are limited to the package or add-on purchased. A revision means one consolidated set of reasonable changes based on the existing direction, not a new brief, new concept, new runtime, new language, new trailer structure, or replacement of supplied materials unless expressly included.
Clients must review previews, proofs, subtitles, translations, trailer cuts, artwork, and approval requests carefully. Once a file is approved, delivered, or used publicly, later changes may be treated as a new revision round, add-on, or new order.
If feedback is not received within 72 hours after a preview, proof, or approval request is delivered, San Roku Ku may continue the project based on the last approved direction.
If the client does not respond to preview, approval, information, or delivery communications within 7 working days, the order may be treated as approved, delivered, and complete.
8. Rush Delivery and Add-ons
Rush delivery fees prioritise scheduling where available. They do not remove the need for client materials, timely feedback, platform access, or third-party cooperation.
Add-ons apply only to the order for which they are purchased and are not transferable to other projects unless agreed in writing.
Format adaptations, editable source files, additional concepts, and other optional deliverables are included only where the relevant package expressly states this or the item is purchased as an add-on.
9. Platform, Distribution, and Third-Party Outcomes
Where we prepare materials for Filmhub, streaming platforms, festivals, distributors, social platforms, or other third parties, we aim to follow the specifications available to us at the time of work. We do not control third-party review decisions, policy changes, technical systems, response times, acceptance, ranking, revenue, audience performance, or distribution results.
San Roku Ku is not responsible for rejection, delay, removal, demonetisation, reduced visibility, revenue changes, policy changes, or technical issues caused by a third party or by client-provided materials, metadata, access, or instructions.
10. Refunds and Cancellations
Refunds, cancellations, corrections, and re-performance are governed by our Refund Policy and the mandatory law applicable to the customer and transaction. Eligibility depends on the work completed, production capacity and third-party costs committed, digital files supplied, and the reason for the request.
Consumers in the United Kingdom, European Union, European Economic Area, Japan, and other locations retain all rights that cannot lawfully be excluded in their country or region. Regional cancellation and withdrawal rules differ; no description of a service as custom, digital, urgent, reserved, or non-refundable overrides a mandatory right.
Where applicable law requires an express request for early service performance or consent before immediate digital supply, any loss or reduction of a cancellation or withdrawal right applies only if the relevant legal requirements were met.
To cancel or request a remedy, email [email protected] with your name, order reference, affected service, and a clear description of the request. No special wording is required.
Nothing in these terms or our Refund Policy removes rights that cannot legally be excluded, including rights relating to services not provided with reasonable care and skill or digital content that is faulty or not as described.
11. Limitation of Liability
To the fullest extent permitted by law, San Roku Ku is not liable for indirect, incidental, special, or consequential loss; loss of profits, revenue, business, opportunity, goodwill, reputation, data, or anticipated savings; platform rejection; distribution failure; or delays caused by client response time, incomplete materials, third-party systems, or events outside our reasonable control.
For business customers only, and where fair and permitted by law, our total liability arising from the relevant service is limited to the amount paid for that service. This cap does not apply to consumer remedies or to liability that cannot lawfully be limited, and nothing in these terms restricts liability where doing so would be unfair or unreasonable.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.
12. Privacy and Data
We handle personal information in accordance with our Privacy Policy. By submitting personal data, project assets, contact details, or third-party information, you confirm that you have authority to provide it for the requested service.
We use optional Google Analytics only after you give analytics consent. Declining or withdrawing analytics consent does not prevent you from using the site, contacting us, or completing checkout. The data collected, purposes, cookies, purchase measurement, providers, retention, and your controls are described in our Privacy Policy.
13. Governing Law
These terms and non-contractual disputes arising from them are governed by the laws of England and Wales, unless mandatory law requires otherwise.
For business customers, the courts of England and Wales have exclusive jurisdiction, except where we agree otherwise in writing. For consumers, this choice does not deprive you of mandatory protections provided by the law of your habitual residence, and you may bring proceedings in any court available to you under applicable consumer law.
Before starting formal proceedings, both parties should make a reasonable attempt to resolve the matter by contacting [email protected]. This does not prevent either party from seeking urgent relief or using a regulator, consumer authority, payment dispute, alternative dispute resolution process, or court where legally available.
